本文件按照GB/T1.1—2020《标准化工作导则第1部分:标准化文件的结构和起草规则》的规
定起草。

引言
为了推进劳动关系和谐企业标准化创建,促进企业科学发展,维护职工合法权益,构建规范有序、
公正合理、互利共赢、和谐稳定的劳动关系,特制定本文件。
体现促进用人单位健康发展,维护职工合法权益,发展和谐劳动关系的要求。
体现引导用人单位履行法律义务与承担社会责任及职工遵守职业道德的要求。
体现加强和创新社会治理,建设社会主义和谐社会的要求。
体现典型示范、正向激励,引导企业创先争优、和谐创建的要求。

劳动关系和谐企业评价规范
1范围
本文件规定了评价省级劳动关系和谐企业的术语和定义、评价内容、评分标准、评价要求、评价方
法和评价结果。
本文件适用于开展湖南省省级劳动关系和谐企业的申报、评审和复核工作。其他单位的劳动关系和
谐企业的申报、评审和复核工作可参照本文件执行。

3术语和定义
下列术语和定义适用于本文件。
3.1
劳动关系laborrelations
用人单位依法招用劳动者为其成员,劳动者在用人单位的管理和受劳动保护下提供有报酬的劳动,
由此用人单位和劳动者双方产生的权利义务关系。
3.2
和谐劳动关系harmoniouslaborrelations
劳动过程中用人单位与劳动者建立的规范有序、公正合理、互利共赢、和谐稳定的劳动关系。
3.3
劳动用工laboremployment
用人单位和劳动者个人签订劳动合同,使劳动者成为用人单位的成员,在用人单位的管理下提供有
偿劳动。
4评价内容及评分细则
4.1劳动用工
4.1.1招工用工应合法规范,无就业歧视、就业欺诈、要求劳动者抵押证件、收取财物等行为。
4.1.2应依法订立、履行、变更、解除和终止劳动合同。
4.1.3应主动履行劳动用工备案义务,依法依规建立职工名册。
4.1.4应依法依规使用劳务派遣工、非全日制用工。
4.1.5企业年度离职率应控制在一定范围内,详见评分细则。企业应依法报告、办理符合规定的经济
性裁员事项。

4.2劳动规章
应依法建立和完善劳动报酬、工作时间、休息休假、职工培训、劳动纪律等制度。
4.3党的建设
4.3.1企业应建立健全党组织,作用发挥充分。党的基层组织完善,在组织职工、宣传职工、凝聚职
工、服务职工中尽职履责。
4.3.2应坚持把党建工作摆在突出位置,有效发挥党员的先锋模范作用。
4.4民主管理
4.4.1应建立职工(代表)大会制度。
4.4.2应实行厂务公开制度或以协商会、恳谈会等形式定期与职工代表(工会)进行沟通,及时了解
并处理职工意见建议。
4.4.3企业应依法建立职工董事、职工监事制度。
4.4.4应定期召开职工(代表)大会,讨论确定规章制度和重大事项,并按照程序告知。
4.5劳动报酬
4.5.1应定期开展工资集体协商,切实发挥工资集体协商在工资收入分配决定机制和工资水平调整机
制中的作用。
4.5.2劳动定额或者计件报酬标准应合理,调整机制应健全。
4.5.3本企业最低工资标准应不低于当地最低工资标准。
4.5.4职工工资增长应参照工资指导线、人力资源市场指导价位,与企业经济效益、劳动生产率提高
相协调。
4.5.5企业应当依法按时足额支付劳动报酬。
4.5.6应依法发放各种津贴,足额支付加班工资。
4.6社会保险与福利
4.6.1应依法履行社会保险登记、申报、缴纳义务。
4.6.2应按照住房公积金管理有关规定为职工缴纳住房公积金。
4.6.3具备条件的企业应建立企业年金、补充医疗为主要形式的补充保险制度。
4.6.4应依法保障职工福利支出,完善福利设施。
4.6.5应建立职工互助互济保障制度,建立困难职工帮扶档案,开展困难职工帮扶工作。
4.7工作时间与休息休假
4.7.1应依法严格执行国家规定的工作时间。需执行特殊工时制的,应依法到人力资源和社会保障部
门申请审批并按审批后相关行政许可严格实施。
4.7.2延长工作时间和支付加班工资应符合法律法规规定,无强迫加班行为。
4.7.3企业应依法依规保障劳动者享有的休息休假权利。
4.8工会建设与集体协商
4.8.1应依法建立具备社会团体法人资格的、组织机构健全的工会组织。
4.8.2应依法保障工会办公和开展活动所需要的资源和条件。
4.8.3应建立集体协商和集体合同制度。

4.9劳动安全和职业健康
4.9.1应遵守和执行国家劳动安全卫生规程和标准。
4.9.2应履行安全生产和职业健康主体责任,健全安全生产、职业卫生管理规章制度、事故应急预案、
工会劳动保护监督检查制度。
4.9.3应严格执行国家、行业和地方适用的安全生产标准,生产经营场所、设备设施、消防设施、安
全警示标志等符合要求,按规定开展安全生产标准化建设。
4.9.4应组织有毒有害岗位职工定期进行职业健康检查,按标准配备个体防护用品。
4.9.5每年应开展职工安全生产和职业健康教育,配备经培训合格的职业健康管理人员,相关作业人
员持证上岗。
4.9.6应对企业安全生产和职业卫生重点部位、重点设备和关键环节开展经常性检查,及时整改事故
隐患。
4.9.7应落实女职工和未成年工特殊保护措施,定期组织健康检查,未使用童工。
4.9.8应有效预防工伤和职业病的发生,无重大安全生产事故和职业危害事故。
4.10劳动争议调处
4.10.1应建立健全劳动争议调解组织和相关制度。
4.10.2应建立劳动关系风险监测预警制度和劳动关系风险处置机制,防止劳动关系群体性、突发性事
件、社会影响重大事件发生。
4.10.3从事人力资源或工会工作四年以上的,应取得相关资质、证照,种类详见评分细则。
4.10.4应经常性宣传普及劳动法律法规,企业主要负责人按规定参加劳动法律知识培训,定期组织开
展劳动法律实施情况的监督自查。
4.10.5职工诉求表达渠道应畅通,无企业原因引发的职工越级上访。
4.11企业文化和社会责任
4.11.1应注重企业文化建设,构建共同愿景,职工对企业的核心价值观和企业精神认同度较高。
4.11.2应结合企业自身特点开展劳动竞赛、技能比武、专题培训、文体娱乐等活动,提高企业的凝聚
力、向心力。
4.11.3应加强人文关怀,关心职工身心健康,积极创建“模范职工之家”。
4.12职工满意度
职工对企业劳动管理、收入待遇、社保待遇、休息休假、福利待遇、劳动条件、民主协商、争议调
处以及企业文化等满意程度高,归属感强。
4.13评分细则
4.13.1评分标准。评分标准按照附录A规定执行。
